1. Which are the MSME’s constitution included under the Scheme?

MSME units such as Individuals / Proprietorship, LLP, Partnership, Private Limited Company or registered company are eligible to be covered under the scheme.

2. Whether any margin money is required to be brought in by the promoters for availing the sub-debt facility?

Yes. The promoters are required to bring in 10% of the sub-debt amount as collateral.

3. What is the duration of the Scheme?

The Scheme would be applicable to sub-debt sanctioned under CGSSD for a maximum period of 10 years from the date the guarantee is availed or till an amount of ₹ 20,000 crore of guarantee amount is approved or till the validity of the scheme.

4. What will be the eligibility criteria for MSMEs to avail the benefit of the Scheme?

All MSME borrower / entities who are stressed viz. SMA2 and NPA accounts and are eligible for restructuring (as per RBI guidelines) and are commercially viable as per the assessment of the lending institutions.

5. Whether the MSME account where the legal / recovery proceedings are underway are eligible under the Scheme?

Yes. In cases where recovery proceedings are underway, such as through SARFAESI Sec. 13(2), 13(4), DRT, suit filed, restructuring, MLIs may carry out on the basis of viability of the MSMEs as per RBI’s restructuring guidelines.

6. Whether Fraud / Willful default account are eligible under the scheme?

Accounts declared as Fraud/ Willful defaulter will not be considered under the scheme.

7.What would be the procedure followed in case a borrower has loan accounts with multiple lenders?

In case a borrower has existing limits with more than one lender, the CGSSD can be availed by the borrower through one lender only. A declaration from the borrower regarding its other banking arrangements and that it has not availed funding under the scheme from the other lenders to be obtained by the lending MLI.

8. To avail sub-debt under DAF-SDSM, will it be necessary for existing loans of the borrower to be covered under existing guarantee schemes such as CGFMU or CGTMSE?

No.

9. Will the interest rate on DAF-SDSM be capped?

Yes. The interest rate applicable would be as per extant RBI guidelines.

10. What would be the tenor of loans provided under DAF-SDSM??

The tenor of sub-debt facility provided under DAF-SDSM shall be as per the repayment schedule defined by the lender, subject to a maximum tenor of 10 years.

11. What would be the tenor of loans provided under CGSSD?

Maximum tenor would be 10 years.

12. Is there any moratorium period prescribed under DAF-SDSM?

Yes. There can be a moratorium of 7 years (maximum) on the payment of principal. Till the 7th year, only interest will be paid. While the interest on the credit facility provided under the scheme would be required to be serviced regularly (monthly), the principal shall be repaid within a maximum of 3 years after completion of moratorium.

13.Whether prepayment of sub-debt facilities is allowed?

Pre-payment of loan/credit facilities is allowed at no additional charge to the borrower.

14. I was running a business and my account turned into NPA due to certain reasons. However, my unit is not running now and it is closed. Am I eligible under the scheme?

No. For availing this sub-debt, the unit must be in running condition and operational.

15. Whether funding under CGSSD scheme can be given to the entity concerned?

No. The Scheme provides funding to Promoters of the MSME unit, and not to the entity concerned.

16. Whether the present scheme envisages additional funding to MSMEs with aggregate exposure limit above Rs 25 crore?

All accounts can be restructured on down-gradation of asset class. An NPA account is already downgraded and can therefore be restructured, even above ₹25 Crore.

17. How to arrive at eligibility for borrowers who are not required to obtain Audited Balance sheet as per statute?

For entities which are not mandated to get their balance sheets audited, lenders may obtain a CA’s certificate or the latest ITR return for calculating the equity /debt contribution of the promoter.

18. Whether accounts which are SMA 2 or NPA as on February 29, 2020 and not irregular on April 30, 2020 can be considered for additional finance under this scheme?

Only accounts which are classified as SMA-2 or NPA as on April 30, 2020 are eligible under the scheme.

19. Whether other legal entities such as Trust/ Society etc. are eligible under the scheme?

Loans under sub-debt scheme can be extended to management committee executives of trust /Society or the Karta of the HUF as per the extant by-laws /resolutions passed by the entity concerned based on the commercial judgement of the banks. Provided such Trust /Societies /HUF are registered as a MSME and fulfil the eligibility criteria stipulated under the Scheme. It may, however, be noted that management committee executives of the Trust / Society may not be willing to take a personal loan and invest it as equity in the Trust / Societies would normally be ‘ not for Profit’ and hence, payment of dividend on equity contribution would normally not be permitted in their case.

20. Whether the promoter has to bring in 10% of the loan amount as cash collateral only?

Yes. Borrower’s own contribution of 10% has to be as cash collateral.

21. Whether account opened after 31.03.2018 and fulling other conditions is eligible under CGSSD scheme.

Accounts that were opened after 31.03.2018 are currently not eligible under the Scheme.

22. Whether the accounts which were restructured before introduction of CGSSD, are eligible for coverage under CGSSD? Further, whether such assistance would be treated as repeated restructuring?

As per the Scheme guidelines, accounts which are eligible for restructuring can be covered under CGSSD. However, restructuring of the account, per se, is not mandatory for coverage under CGSSD. Accordingly, any account which has been restructured prior to introduction of CGSSD and satisfies other eligibility criteria, can also be covered under the Scheme. Further, it has also been clarified that credit facility sanctioned under Sub Debt Scheme would not amount to restructuring of the entity concerned. Also, since under the Scheme, assistance is provided to the promoters in the form of personal loan and not to the MSME unit, it should not be treated as repeated restructuring of the account.

23. Please clarify whether the term “regular in operation”, used in clauses 5(v) and 8(i), refers to ‘operation in the account of the MSME with the banks’ or ‘operation in the unit concerned’?

It is clarified that the term “regular in operation”, in the captioned clauses refer to regular operation / functioning of the MSME unit. Accordingly, the unit should be functional during FY 2017, FY 2018, FY 2019 and FY 2020, irrespective of the transactions in their bank accounts.

24. Please clarify whether accounts opened after 01.01.2016 and which are fulfilling other terms and conditions of the Scheme are eligible for coverage.

No. It has been decided that accounts opened after 01.01.2016 and fulfilling other terms and conditions of the Scheme are not eligible for coverage under the Scheme.

25. Is a Chartered Accountant’s certificate is required to be obtained for substantiating infusion of sub-debt /credit released to the promoter into the business as equity/quasi equity/sub-debt ?

It is not required to obtain Chartered Accountant’s certificate. However, MLI should ensure that the sub-debt / credit released to the promoter is brought back as equity / quasi equity / sub-debt in the MSME unit.

26. Any cut-off date / eligibility is prescribed for MSMEs for availing the benefit under the Scheme?

The scheme is applicable for those MSMEs whose accounts have been standard as on 01.01.2016 and have been in regular operations, either as standard accounts or as NPA accounts during the financial year 2016-17, 2017-18, 2018-19 and 2019-20 even if they did not remain in regular operation in FY 2020-21 & FY 2021-22 provided such accounts are viable as per MLI’s assessment and expected to come out of financial stress by availing this facility.

एमएसएमई यूनिट जैसे व्यक्ति / प्रोप्राइटरशिप, एलएलपी, साझीदारी, प्राइवेट लिमिटेड कंपनी या पंजीकृत कंपनी योजना के तहत शामिल होने के योग्य हैं।

2. उप-ऋण सुविधा का लाभ प्राप्त करने के लिए प्रमोटरों को कितनी मार्जिन मनी लानी होगी?

हाँ। प्रमोटरों को उप-ऋण राशि का 10% सुरक्षा रूप में लाना आवश्यक होता है।

3. योजना की अवधि क्या होगी?

योजना CGSSD के तहत संविदा में स्वीकृत उप-ऋण के लिए 10 वर्ष की अधिकतम अवधि होगी, जो गारंटी प्राप्त की जाती है या जब तक ₹ 20,000 करोड़ की गारंटी राशि स्वीकृत की जाती है या योजना की वैधता होती है।

4. एमएसएमई को योजना के लाभ प्राप्त करने के लिए पात्रता मानदंड क्या होंगे?

एमएसएमई के सभी कर्जदार / संस्थान जो स्ट्रेस्ड हैं जैसे कि SMA2 और NPA खाते हैं और RBI दिशानिर्देशों के अनुसार पुनर्गठन के योग्य हैं और ऋण देने वाली संस्थानों के मूल्यांकन के अनुसार वाणिज्यिक योग्य हैं।

5. क्या योजना के तहत कानूनी / पुनर्प्राप्ति प्रक्रियाएं चल रही हैं उन एमएसएमई खातों को पात्र माना जाएगा?

हाँ। जहां पुनर्प्राप्ति प्रक्रियाएं चल रही हों, जैसे कि SARFAESI धारा 13 (2), 13 (4), DRT, मुकदमा दायर, पुनर्गठन के माध्यम से, MLIs आधारित मौजूदा ऋणीयों की व्यावहारिकता के आधार पर कार्ययोजना कर सकते हैं। RBI के पुनर्गठन दिशानिर्देशों के अनुसार।

6. क्या योजना के तहत धोखाधड़ी / स्वेच्छा से अवकाशित खाता पात्र होंगा?

धोखाधड़ी / स्वेच्छा से अवकाशित खाते को योजना के तहत मान्य नहीं किया जाएगा।

7. जब किसी उधारकर्ता के पास कई उधारकर्ताओं के साथ कार्यकारी हों, तो कौनसा प्रक्रिया अनुसरण किया जाएगा?

जब किसी उधारकर्ता के पास एक से अधिक उधारकर्ता के साथ मौजूदा सीमा होती है, तो CGSSD को उधारकर्ता द्वारा केवल एक उधारकर्ता के माध्यम से प्राप्त किया जा सकता है। ऋण देने वाले MLI द्वारा उधारकर्ता के अन्य बैंकिंग व्यवस्थाओं के बारे में एक घोषणा लेनी होगी और इसकी प्राप्ति के लिए योजना के अन्य ऋण देने वालों से धनराशि उपलब्ध नहीं की जाती है।

8. DAF-SDSM के तहत उप-ऋण प्राप्त करने के लिए क्या मौजूदा कर्ज को CGFMU या CGTMSE जैसी मौजूदा गारंटी योजनाओं के तहत शामिल करना आवश्यक होगा?

नहीं।

9. DAF-SDSM पर ब्याज दर सीमित होगी?

हाँ। लागू होने वाली ब्याज दर वर्तमान RBI दिशानिर्देशों के अनुसार होगी।

10. DAF-SDSM के तहत प्रदान की जाने वाली ऋण की अवधि क्या होगी?

DAF-SDSM के तहत प्रदान की जाने वाली उप-ऋण सुविधा की अवधि ऋण देने वाले द्वारा निर्धारित अदायगी योजना के अनुसार होगी, जो 10 वर्षों की अधिकतम अवधि तक होगी।

11. CGSSD के तहत प्रदान की जाने वाली ऋण की अवधि क्या होगी?

अधिकतम अवधि 10 वर्ष होगी।

12. DAF-SDSM के तहत कोई मोरेटोरियम अवधि निर्धारित होती है क्या?

हाँ। प्राथमिक भुगतान की 7 वर्ष (अधिकतम) तक मोरेटोरियम हो सकता है। 7 वर्ष तक, केवल ब्याज देय होगा। जबकि योजना के तहत प्रदान की गई क्रेडिट सुविधा के ब्याज को नियमित रूप से (मासिक) सेवा किया जाना चाहिए, मूल राशि को मोरेटोरियम पूर्ण होने के बाद 3 वर्षों के अधिकतम अवधि में चुकता किया जाना चाहिए।

13. क्या उप-ऋण सुविधाओं की पूर्व-भुगतान की अनुमति है?

ऋण/क्रेडिट सुविधाओं की प्री-भुगतान ऋण लेनेवाले को कोई अतिरिक्त शुल्क नहीं देने की अनुमति है।

14. मैं एक व्यवसाय चला रहा था और कुछ कारणों से मेरा खाता NPA में बदल गया है। हालांकि, मेरी यूनिट अब नहीं चल रही है और बंद हो गई है। क्या मैं योजना के तहत पात्र हूँ?

नहीं। इस सब-ऋण का लाभ उठाने के लिए, यूनिट को चल रही स्थिति और संचालन में होना चाहिए।

15. क्या सीजीएसएसडी योजना के तहत निधि प्राप्त की जा सकती है?

नहीं। योजना माइक्रो, छोटे और मध्यम उद्यमों के प्रमोटरों को निधि प्रदान करती है, न कि संबंधित संगठन को।

16. क्या वर्तमान योजना माइक्रो, छोटे और मध्यम उद्यमों को 25 करोड़ रुपये से अधिक आपूर्ति सीमा के साथ अतिरिक्त वित्त प्रदान करने की योजना बनाती है?

सभी खाते संपत्ति वर्ग को नीचे गिराने पर पुनर्गठित किए जा सकते हैं। एक NPA खाता पहले से ही डाउनग्रेड हो चुका है और इसलिए उसे पुनर्गठित किया जा सकता है, इससे ऊपर ₹25 करोड़।

17. किसी कानून अनुसार सत्यापित वित्तीय विवरण प्राप्त करने की आवश्यकता न होने वाले उधारकों की पात्रता कैसे निर्धारित की जाए?

वित्तप्रदायकों को ऐसे संगठनों के लिए जिनको उनके वित्तीय विवरणों को सत्यापित करने के लिए अनिवार्यतः बनाया नहीं गया है, एक CA का प्रमाण पत्र या प्रमोटर के पूंजी /कर्ज योगदान की गणना के लिए नवीनतम ITR रिटर्न प्राप्त कर सकते हैं।

18. क्या वे खाताएं जो 29 फरवरी 2020 को SMA 2 या NPA हैं और 30 अप्रैल 2020 को अनियमित नहीं हैं, इस योजना के तहत अतिरिक्त वित्त पर विचार किए जा सकते हैं?

केवल वे खाताएं जो 30 अप्रैल 2020 को SMA-2 या NPA के रूप में श्रेणीबद्ध हैं, इस योजना के तहत पात्र हैं।

19. क्या ट्रस्ट/सोसाइटी आदि जैसे अन्य कानूनी संगठन योजना के तहत पात्र हैं?

सब-ऋण योजना के तहत उद्यम संचालन समिति के कार्यकारी निदेशकों, ट्रस्ट/सोसाइटी के कर्ता, या हिन्दू संयुक्त परिवार के कार्ता को ऋण प्रदान किया जा सकता है, प्रासंगिक बैंकों के वाणिज्यिक मूल्यांकन के आधार पर नियमानुसार। इसके साथ ही, यह ध्यान देना चाहिए कि ट्रस्ट/सोसाइटी के कार्यकारी निदेशक पर्सनल ऋण लेने और इसे प्रतिष्ठान /समाज के हित में निवेश करने के लिए तत्पर नहीं हो सकते हैं, और अतः, उनके मामले में आमतौर पर इतर अनुपात पर भागीदारी के वेतन का भुगतान नहीं किया जा सकता है।

20. क्या प्रमोटर को केवल नकदी उत्पाद के रूप में कर्ज राशि के 10% को लाना चाहिए?

हाँ। ऋणी की खुद की योगदान 10% नकदी उत्पाद के रूप में होनी चाहिए।

21. क्या 31.03.2018 के बाद खोले गए खाते और अन्य शर्तों को पूरा करने वाले पात्र हैं एसजीएसएसडी योजना के तहत?

31.03.2018 के बाद खोले गए खाते वर्तमान में योजना के तहत पात्र नहीं हैं।

22. क्या ऐसे खाते, जिन्हें सीजीएसएसडी के प्रारंभ होने से पहले पुनर्गठित किया गया था, सीजीएसएसडी के तहत कवर किए जा सकते हैं? इसके अलावा, क्या ऐसी सहायता को दोहरी पुनर्गठन के रूप में माना जाएगा?

योजना दिशानिर्देशों के अनुसार, पुनर्गठन के योग्य खाते सीजीएसएसडी के तहत कवर किए जा सकते हैं। हालांकि, खाते का पुनर्गठन प्रत्येक, स्वयं में, सीजीएसएसडी के तहत कवर करने के लिए अनिवार्य नहीं है। इसी तरह, किसी खाते को जो सीजीएसएसडी के प्रारंभ से पहले पुनर्गठित किया गया है और अन्य पात्रता मानदंडों को पूरा करता है, उसे भी योजना के तहत कवर किया जा सकता है। इसके अलावा, साफ हो गया है कि सब डेब्ट योजना के तहत मुद्रास्फीत की गई क्रेडिट सुविधा का आवंटन न तो प्रभावित प्राधिकरण के पुनर्गठन को दर्शाता है और न ही इसे दोहरी पुनर्गठन के रूप में माना जाना चाहिए।

23. कृपया स्पष्ट करें कि वाक्यांश 5(v) और 8(i) में प्रयुक्त शब्द "संचालन में नियमित", 'बैंकों के संकेतों में खाता' या 'संबंधित प्रकरण में संचालन' से संबंधित है?

स्पष्ट किया जाता है कि "संचालन में नियमित" शब्द, उपशीर्षकित वाक्यांशों में, संचालित / प्रतिष्ठित MSME इकाई के नियमित संचालन / कार्यान्वयन से संबंधित है। इस प्रकार, खाता वित्तीय वर्ष 2017, वित्तीय वर्ष 2018, वित्तीय वर्ष 2019 और वित्तीय वर्ष 2020 के दौरान सक्रिय होनी चाहिए, बैंक खातों में उनके लेन-देन के बावजूद।

25. क्या चार्टर्ड एकाउंटेंट के प्रमाणपत्र को प्राप्त करने की आवश्यकता होती है जो प्रमोटर द्वारा व्यापार में खान के रूप में सब-डेब्ट / क्रेडिट जारी किया गया है?

चार्टर्ड एकाउंटेंट के प्रमाणपत्र को प्राप्त करने की आवश्यकता नहीं होती है। हालांकि, MLI को सुनिश्चित करना चाहिए कि सब-डेब्ट / क्रेडिट प्रमोटर द्वारा जारी किया गया, MSME इकाई में इक्विटी / क्वासी इक्विटी / सब-डेब्ट के रूप में लाए जाते हैं।

26. MSMEs के लिए लाभ उपलब्ध कराने के लिए कोई कटऑफ तिथि / पात्रता निर्धारित होती है?

योजना उन MSMEs के लिए लागू होती है जिनके खाते 01.01.2016 को मान्य हैं और वित्तीय वर्ष 2016-17, 2017-18, 2018-19 और 2019-20 के दौरान, चाहे वे नियमित खाते हों या NPA खाते हों, नियमित चालू रहे हों, यद्यपि उन्होंने वित्तीय वर्ष 2020-21 और 2021-22 में नियमित चालू नहीं रहे थे, प्रासंगिक एमएलआई के मूल्यांकन के अनुसार उन खातों को वाणिज्यिक तनाव से बाहर निकलने की उम्मीद है जो इस सुविधा का लाभ उठाकर आएगा।
